The statutory following Rhode Island Refusal Penalties may be imposed upon a conviction for a Refusal charge:
Rhode Island Refusal Penalties for a First Offense
(1) Six to twelve month driver’s license suspension
(2) Ten to sixty hours of community service
(3) Fines up to five hundred ($500) dollars
(4) Costs and Assessments
(5) Driver Retraining School
Rhode Island Refusal Penalties for a Second Offense within 5 Years
(1) Up to six months in prison
(2) One to two year driver’s license suspension
(3) Sixty to one hundred hours of community service
(4) Fines up to one thousand ($1,000) dollars
(5) Costs and Assessments
(6) Mandatory substance abuse treatment
Rhode Island Refusal Penalties for a Third or Subsequent Offense within 5 Years
(1) Up to one year in prison
(2) Two to five year driver’s license suspension upon release from prison
(3) No less than one hundred hours of community service
(4) Fines up to one thousand ($1,000) dollars
(5) Costs and Assessments
(6) Mandatory substance abuse treatment. Additionally, prior to having the driver’s license reinstated, any driver who has had three violations of the Refusal statute within a three year period must appear before a judge and demonstrate “good behavior” warranting the return of the driver’s license.
