The statutory following Rhode Island DUI Penalties may be imposed upon a criminal conviction for a DUI:

Rhode Island DUI Penalties for a First Offense

Rhode Island DUI Penalties:  First Offense.  Blood alcohol concentration between .08 and .099

(1)  Up to one year in prison

(2)  Thirty to one hundred and eighty day driver’s license suspension

(3)  Ten to sixty hours of community service

(4)  Fines up to three hundred ($300) dollars

(5)  Costs and Assessments

(6)  Driver Retraining School

Rhode Island DUI Penalties:  First Offense.  Blood alcohol concentration between .10 and .149

(1)  Up to one year in prison

(2)  Three to twelve month driver’s license suspension

(3)  Ten to sixty hours of community service

(4)  Fines up to three hundred ($300) dollars

(5)  Costs and Assessments

(6)  Driver Retraining School

Rhode Island DUI Penalties:  First Offense.  Blood alcohol concentration greater than .15

(1)  Up to one year in prison

(2)  Three to eighteen month driver’s license suspension

(3)  Twenty to sixty hours of community service

(4)  Fine of Five hundred ($500) dollars

(5)  Costs and Assessments

(6)  Driver Retraining School

Rhode Island DUI Penalties for a Second Offense within 5 Years

For the purpose of determining a license suspension, a prior offense includes any violations of the Refusal statute.  Additionally, any violation of the DUI laws of another state counts as an offense in Rhode Island.

Rhode Island DUI Penalties: Second Offense within 5 years.  Blood alcohol concentration between .08 and .149

(1)  Up to one year in prison, with a mandatory ten days to serve in prison

(2)  One to two year license suspension

(3)  Mandatory substance abuse treatment

(4)  Fine of four hundred ($400) dollars

(5)  Costs and Assessments

Rhode Island DUI Penalties: Second Offense within 5 years.  Blood alcohol concentration greater than .15

(1)  Up to one year in prison, with a mandatory six months to serve in prison

(2)  Two year driver’s license suspension upon release from prison

(3)  Mandatory substance abuse treatment

(4)  Fine of one thousand ($1,000) dollars

(5)  Costs and Assessments

Rhode Island DUI Penalties: Third Offense within 5 years.  Blood alcohol concentration between .08 and .149

(1)  Up to three years in prison, with a mandatory one year to serve in prison

(2)  Two to three year driver’s license suspension upon release from prison

(3)  Mandatory substance abuse treatment

(4)  Fine of four hundred ($400) dollars

(5)  Costs and Assessments

(1)  Up to five years in prison, with a mandatory three years to serve in prison

(2)  Two to three year license suspension upon release from prison

(3)  Fines up to five thousand ($5,000) dollars

(5)  The vehicle may be seized and sold by the State of Rhode Island.
